These terms form the participation agreement between Smash Serve Pty Ltd ("Smash Serve", "we", "us") and the parent or guardian registering a child for our programs. By registering your child, you confirm that you have read, understood, and agree to these terms on behalf of your child.
01 Eligibility & Participation
Smash Serve programs and leagues are open to children aged 5 to 18, as outlined in the registration form. Participants are grouped by skill level and program.
Sessions are conducted in a supportive and inclusive environment. Smash Serve reserves the right to modify session times, format, or venues as necessary.
02 Parent/Guardian Responsibilities
A parent or legal guardian must register each child and is responsible for ensuring the participant arrives on time and is collected promptly after each session.
Parents and guardians are expected to behave respectfully toward all staff, volunteers, other parents, and players. Abusive, aggressive, or unruly behaviour will not be tolerated and may result in removal from the venue and/or future sessions.
03 Assumption of Risk
I understand that participation in badminton and related sporting activities involves inherent risks, including but not limited to physical injury, strains, sprains, falls, or accidents.
I voluntarily accept these risks on behalf of my child and acknowledge that Smash Serve, its coaches, volunteers, venue operators, Badminton Australia, and Badminton Victoria cannot eliminate all risks associated with participation. It is the responsibility of the parent or guardian to ensure the child is physically fit and in good health to participate, and parents are encouraged to hold personal accident or private health cover for their child if desired.
04 Code of Conduct
Participants and parents/guardians agree to:
- Treat all players, coaches, volunteers, and officials with respect.
- Follow the instructions of coaching staff and venue coordinators.
- Maintain good sportsmanship, regardless of match outcomes.
- Refrain from any aggressive or disruptive behaviour, including shouting, pushing, or bullying.
Smash Serve reserves the right to remove any player or parent exhibiting inappropriate behaviour, and to suspend or cancel participation at its discretion without refund where behaviour poses a safety risk or disrupts the program.
05 Medical & Health Declaration
- I confirm that my child is medically and physically fit to participate in this program.
- I agree to inform the organisers of any relevant medical conditions, allergies, injuries, or special requirements prior to participation.
- In the event of an emergency, I authorise Smash Serve staff to administer basic first aid and to seek medical treatment or contact emergency services for my child if deemed necessary. All reasonable attempts will be made to contact the parent or guardian immediately.
06 Liability Release
To the fullest extent permitted by law, I release and indemnify Smash Serve, its staff, volunteers, venue partners, Badminton Australia, Badminton Victoria, and affiliated organisations from any liability, loss, damage, or claim arising from my child's participation, except where caused by proven negligence.
07 Photography & Media Consent
I consent to photographs and/or video recordings of my child being taken during the program for promotional, marketing, and reporting purposes by Smash Serve and its affiliated sporting bodies.
Opting out: If you do not consent to photography or media use, please notify us in writing at admin@smashserve.com.au prior to the program commencing, and we will respect that request.
08 Program Delivery & Changes
I acknowledge that session content, coaches, or schedules may be adjusted due to operational requirements, weather, venue availability, or safety considerations.
6.1 Membership & Billing
Programs are offered on a rolling monthly membership basis with no fixed-term lock-in. Your membership grants access to the program for the billing period, not a guarantee of attendance at any individual session.
6.2 No Refund Policy
All registrations and payments are non-refundable. This includes, but is not limited to:
- Change of mind
- Inability to attend individual sessions
- Absence due to holidays, illness, or personal reasons
Once a booking is confirmed, no cash refunds will be provided.
6.3 Session Makeups
Where a participant misses a scheduled session, makeup options may be available at management's discretion and subject to availability — for example, attending an alternative class in the same week. Makeups are a goodwill offering, not a guaranteed entitlement, and do not constitute a refund.
6.4 Medical Emergency Credit (Management Discretion)
In the event of a genuine medical emergency, Smash Serve may, at its sole discretion, offer a credit toward a future Smash Serve program. Conditions:
- Medical emergencies must be supported by appropriate documentation (e.g. medical certificate).
- Credits are not guaranteed and are assessed on a case-by-case basis.
- Approved credits are non-transferable, not redeemable for cash, and must be used within a specified timeframe as advised by management.
6.5 Program Cancellation by Organiser
If Smash Serve is required to cancel a session or program due to unforeseen circumstances (e.g. venue closure, safety concerns), participants will be offered either a make-up session or a credit toward a future program.
09 Venue Rules
Participants and parents/guardians must comply with all venue-specific rules and guidelines, including appropriate footwear (non-marking court shoes) and facility access restrictions.
Smash Serve is not responsible for any personal property lost or stolen during sessions.
10 Changing or Cancelling Your Membership
We keep this simple and personal. To change your plan (for example, moving between once-a-week and twice-a-week) or to cancel your membership, just get in touch with us directly:
Message or call us on 0434 804 841, or email admin@smashserve.com.au. We'll confirm the change with you. Changes and cancellations take effect from your next billing period; the current period is non-refundable as set out above.
11 Acknowledgement
By registering for this program, I acknowledge and accept the Code of Conduct and the No Refund & Credit Policy outlined above. I confirm that I have read, understood, and agree to the terms of this participation agreement on behalf of my child.
